Florida Court Rules Red Light Cameras Illegal

A Miami-Dade County Circuit Court judge has ruled that red light cameras may not be legally used to issue traffic citations in the state of Florida. Judge Gerald Bagley yesterday dismissed charges against motorist Richard Masone who had received a red light camera ticket in the mail from American Traffic Solutions (ATS). The company operates the program on behalf of the city of Aventura.

"What I'm doing is pretty much tracking the advisory opinion offered by the attorney general that tickets should be issued by a law enforcement officer who has observed the action on the part of the alleged violator running a red light," Judge Bagley ruled from the bench. "So the fact that there is not any other components, if you will, to this unmanned camera, such as an officer or any other mechanism for observing the actions of the alleged violator, I find that to be invalid. That is the reason behind my ruling. Thank you. Have a great day."

That rules. Obviously I don't run redlights but I don't like the direction cameras for redlights and speeding take us.

I posted it up a few weeks back i think but an alabama mayor took down the redlight cameras in his city. the problem is the city/state doesnt own those cameras, its a 3rd party company. the state/city usually only sees like 30cents on the dollar for each ticket they issue.

True that.

I've seen more trouble caused by redlight cameras then anything. In this one intersection near my house, some people will panic when the light changes to yellow. They will ether 1) Slam the brakes 2) gun it. Ive seen rear-endings on several occasions due to the fear of getting a ticket. For awhile in California, if you got a redlight camera ticket and refused to pay it they couldnt do anything about it.

More driver education and more strenuous testing procedures? I can't stand how bad most drivers are, they don't pay attention, are very selfish and many are outright dangerous. More widespread use of turn signals, lane discipline and general courtesy would be nice.

Yea it's too bad that we have to resort to these measures. Nobody gives a shit, operating an automobile is not a important thing since we do it every day, right?

their all over the next county from me but its fine because i hardly go into that county.

i have an escort 9500ix and it has built in database for redlights and speed cameras. so long story short, back in december a bunch of us were going to a toys for tots cruise. i rolled through a red light making a right turn. my detector never went off. i hadnt updated the database of cameras since october so it was out of date. i updated it a month ago, ended up going passed that exact same spot and wouldnt ya know.. the detector went off lol
